Can a Landlord Increase Rent Anytime?

One of the most common questions asked by both Owners and Tenants is:

"Can the landlord increase the rent whenever they want?"

The short answer is:

Not automatically.

For a Leave and License Agreement in Maharashtra, the rent and any future increase are generally governed by the terms that both parties mutually agree upon and include in the agreement.

What Is a Rent Increment Clause?

A Rent Increment Clause specifies:

  • When the rent will increase
  • By how much
  • How often the increase will happen

Example:

  • 5% after 11 months
  • 5% after 12 months
  • 7% after every renewal

The percentage is not fixed by law for all agreements. It depends on what the Owner and Tenant mutually agree.

Is 10% Rent Increase Mandatory?

No.

A common misconception is that rent must increase by 10%.

There is no universal rule that says every agreement must have a 10% increase.

Different agreements may have:

  • No increase
  • 5% increase
  • 8% increase
  • 10% increase
  • Any other mutually agreed percentage

The important point is that both parties agree before signing.

What If the Agreement Does Not Mention Any Increase?

If there is no rent increment clause, then the agreement should generally be followed as written for its duration.

If either party wishes to change the rent during the agreement period, it is advisable to do so through mutual agreement rather than unilateral action.

Why Is It Important to Mention the Rent Increase Clearly?

A clearly written clause helps avoid disputes later.

It should mention:

  • Percentage or revised rent
  • Effective date
  • Whether it applies during renewal or the existing agreement
  • Any special conditions

Common Mistakes

❌ Assuming every agreement has a 10% increase.

❌ Leaving the increment clause blank.

❌ Relying only on verbal discussions.

❌ Not reading the agreement before signing.

Best Practice

Before signing your Rent Agreement, make sure both parties clearly understand:

✔ Monthly Rent

✔ Security Deposit

✔ Agreement Period

✔ Notice Period

✔ Rent Increment (if applicable)

Everything important should be documented in writing.

Final Thoughts

A Rent Agreement is meant to create clarity—not confusion.

If you expect the rent to increase in the future, include a clear rent increment clause in the agreement.

This helps both the Property Owner and the Tenant understand their rights and responsibilities from the beginning.
